- Cartels: Price-fixing, market sharing, and limiting production are illegal. Fines can reach 10% of worldwide turnover.
- Abuse of Dominance: Prohibited for enterprises with significant market power (presumed at 40% market share).
- Concentrations (Mergers): Must be authorized by KCA if combined turnover exceeds €20 million worldwide and specific domestic thresholds.
Consumer Protection
The law aligns with EU directives, protecting consumers against:
- Unfair Practices: Misleading actions or omissions and aggressive marketing.
- Contracts: Consumers have a 14-day right of withdrawal for distance and off-premises contracts.
- Product Conformity: Consumers are entitled to repair, replacement, or refund for defective goods (2-year legal guarantee).
